In the Name of God Amen I William Wrathall of Burnsall in the Parish of Burnsall and county of York yeoman being of sound and disposing mind do make and publish this my last Will and Testament in manner following First I will that all my just debts legacies funeral expences and the probate of this my will be paid by my executor hereinafter named Also I give and devise all that my land and allotment in Coniston New Close with the cattle gaits on the Bycliffe and the common rights thereunto belonging with all their appurtenances lying and being in the township of Coniston and Parish of Burnsall aforesaid to my nephew William Wrathall son of my brother Stephen Wrathall deceased his heirs and assigns for ever subject to the payment of one hundred and fifty pounds to his sister Susannah Atkinson and subject to the payment of further sums of one hundred pounds apiece to his sisters Mary and Margaret Wrathall their heirs or assigns if they should die leaving any such but provided that any one or more of them should die before their legacies become due in such case their legacies shall be equally paid to the survivors or survivor of them And I also will that this estate shall be further charged with the payment of one hundred pounds to my nephew William Wrathall of London my executor Also I give devise and bequeath all my land and allotments and dale in the Mire lying and being at Edge Top in the township of Grassington and a house and barn thereon with all rights and privileges to the aforesaid premises appertaining to my brother John during the term of his natural life and after his decease to his son Lupton Wrathall his heirs and assigns for ever subject to the payment of one hundred pounds apiece to each of his brothers and sisters except his brother John for whom I have provided in another part of my will which said legacies shall be paid to them severally within twelve months of the decease of my brother or to their lawful issue but provided that any of them die before their legacies become due leaving no lawful issue that then his or their legacy or legacies shall be paid equally amongst the survivors Also I give devise and bequeath to my nephew William Wrathall of Watts Close near Guisburn his heirs and assigns for ever all those my lands called Bank Lands together with the houses now inhabited by Widow Haworth and John Smith (except the Backpart of Haworth’s parlour now inhabited by Blackey) with the stable hay loft cart house and half the garden on the west side together with the site for the manure subject to the payment of a mortgage of three hundred pounds to the executors of the late William Atkinson of Weston deceased and also subject to the further payment of one hundred and fifty pounds to my nephew William Wrathall of London and also subject to the further payment of fifty pounds apiece to his brother Stephen Wrathall of London and his sister Ellen or their respective heirs and assigns I also give devise and bequeath to my nephew John Wrathall all those of my lands lying and being within the township of Grassington in the Parish of Linton known by the name of the Coves with a barn thereon during the term of his natural _ and at his decease to his son William and in case he should die before his father I then will that the said lands shall fall to his next heir and assigns for ever I also give devise and bequeath to my nephew John Wrathall now residing with me all my stock of cattle consisting of beasts sheep and horses together with all my implements of husbandry and husbandry geers of every description and all my crop of hay corn and eatage he paying all interest of money owing by me up to Martinmas next and all rents due or becoming due by the sixth day of April next ensuing I also give and bequeath to my said nephew John Wrathall residing with me the whole of my household furniture of whatever nature or description the same is except my best bed and bedstead with hangings and the bedding thereunto belonging which I give and bequeath to my niece Susannah Hartley It is however my will that the land called Coves and my stock of cattle shall be charged with the payment of a legacy of two hundred pounds to my nephew Richard Wrathall son of my brother Richard deceased and also subject to the further payment of a legacy of one hundred and fifty pounds to Elizabeth Daughter of Mary Blenkhorn formerly my housekeeper and in case of any default of payment of these two said legacies it shall be lawful and I hereby empower my Executor to enter upon the said land called Coves and also to take possession of the aforesaid stock of cattle to hold and enjoy the same till the aforesaid legacies are fully paid and satisfied I give unto my nephew Lupton Wrathall my Silver Pint I give devise and bequeath to my niece Susannah Hartley her heirs and assigns for ever one Parrock at the Horse Gait Yate now in the occupation of Dr Hartley and a small croft and Parrock called the Tear? situate at Grassington I also give devise and bequeath to my nephew William Wrathall of London son of my brother Lupton Wrathall deceased his heirs and assigns for ever all those lands enclosures and allotments lying situate and being within the townships of Coniston and Grassington with the buildings thereon lately purchased of the Revd Murray Holmes of Bramley Hill Top near Leeds with the cattle gait on Bycliffe Common right royalties and all manorial rights and privileges to the same appertaining And I also give devise and bequeath to the said William Wrathall of London his heirs and assigns for ever all those pieces or parcels of land known by the name of Laithhouse Leys and two small Parrocks above the Horse Gait Yate with all their rights and privileges together with three dwellinghouses now inhabited by Ann Wrathall Nanny Calvert and _ Brunt with half of the garden the barn and all other conveniences which are under the same roof all situated and being at Grassington I also give devise and bequeath to my said nephew William Wrathall aforesaid of London his heirs and assigns for ever all my estate of lands houses and barns with outbuildings rights and privileges and appurtenances to the said premises appertaining lately the property of Margaret Stackhouse of Burnsall deceased situate at Burnsall subject to the payment of an annuity of five pounds a year to my niece Mary Creshaw the first payment to be made to her within twelve months after my decease and to be continued yearly and every year during the term of her natural life In case that any of the aforesaid legacies or annuities bequeathed by me as above at the expiration of twelve months after my decease be unpaid for the space of thirty days after the same shall become due being first legally demanded it shall and may be lawful for the said legatees and the said annuitants to enter such part of the said premises or property as have been hereinbefore charged and chargeable with the payment of such legacies or such annuities respectively and the same to keep end enjoy untill such annuity or legacy in arrear shall be fully paid and discharged together with lawful interest of such money for the time it shall have been so in arrear And I expressly will and direct that my four estates left to my nephews William Wrathall of London William Wrathall of Watts Close near Guisburn William Wrathall of Coniston and Lupton Wrathall of Haworth shall each respective estate be charged and chargeable with the annuity or payment of two pounds and ten shillings each annually to John Wrathall son of my brother Henry deceased during the term of his natural life the first payment to be made within twelve months after my decease and to be continued yearly during the said term And I further will that the legatees who are in a state of minority shall respectively receive their legacies within twelve months after they severally attain the age of twenty one years Lastly I do hereby nominate constitute and appoint the aforesaid William Wrathall of London son of my brother Lupton Wrathall deceased sole executor of this my last Will and Testament revoking all former wills by me made In witness whereof I have hereunto set my hand and seal to this the last sheet of my last will and testament and my hand to the first ????
