This is the last Will and Testament of me Richard Wrathall of Linton near Burnsall in the West Riding of the County of York Yeoman made this Fourth day of June in the year of our Lord one thousand eight hundred and thirty eight in manner following that is to say I direct my Executors hereinafter named and appointed to pay all my just debts funeral and testamentary expences out of my personal estate with all convenient speed after my decease I give devise and bequeath all that my Messuage or dwellinghouse situate in Burnsall aforesaid with the Garden Garth and appurtenances thereunto adjoining and belonging And also a Close of land called Byrea or Byrey and a small Paddock called Mouse Gill and an allotment of land called the Old Woman Allotment containing about two acres all which said Close of land Paddock and allotment are situate at or near Burnsall aforesaid and the same together with the said Messuage Garden Garth and premises are now in the occupation of Joseph Birch as tenant thereof unto Lupton Wrathall of Appletreewick near Burnsall aforesaid for and during the term of his natural life And from and after his decease then I give devise and bequeath the same unto and equally between all and every the children of the said Lupton Wrathall their heirs executors administrators and assigns according to the tenure thereof and to take and hold as tenants in common and not as joint tenants And I hereby charge and make chargeable all my said real estates with the payment of the Annuity or yearly sum of Six pounds to John Wrathall the son of Henry Wrathall deceased during his life And I direct that the said Annuity or annual sum of Six pounds shall be paid to the said John Wrathall by even half yearly payments and the first half yearly payment thereof to be made at the expiration of six calendar months after my decease And I give power to the said Annuitant to recover the said Annuity when in arrear for the space of twenty one days and all costs and charges of such recovery by distress and sale in like manner as rack rents are recoverable by Law And I hereby also charge and make chargeable all my said real estates with the payment of the legacy or sum of One hundred pounds which I give and bequeath unto Richard Coulton Wrathall and I direct the same to be paid to him upon his attaining the age of twenty one years I give and bequeath unto Isabel Tomlinson the wife of Edmond Tomlinson of Over Kellet near Burton Lancaster the legacy or sum of One hundred pounds And I give and bequeath unto Mary Tindal the wife of John Tindal the legacy or sum of One pound All the rest residue and remainder of my personal estate and effects of what nature or kind soever and wheresoever I give and bequeath unto and equally between all and every my nephews and nieces the children of my late Uncle and Aunts William Tindal Jane Hutton and Mary Wood deceased absolutely share and share alike And I nominate and appoint the said Lupton Wrathall and William Wrathall of Conistone near Kilnsey joint Executors of this my Will and hereby revoking all former wills by me made I publish and declare this Instrument in writing to be and contain my last Will and Testament In Witness whereof I have hereunto set my hand and seal the day and year above written Richard Wrathall (image of seal) Signed sealed published and declared by the above named Richard Wrathall the Testator as and for his last Will and Testament in the presence of us who in his presence at his request and in the presence of each other have hereunto subscribed our names as witnesses the words Linton near on the first side hereof and the words the payment of having been first interlined John Hammond Solr West Burton Elizabeth Hammond Passed 31st Janry 1840 |
