This is the Last Will and Testament of me Robert Wreathall of North Newbald in the County of York Gentleman maid this twenty first day of February in the year of our Lord One thousand eight hundred and twelve I Give and Bequeath unto William King of North Newbald aforesaid Gentleman and Thomas Bainton of Wandsford in the said County of York Yeoman the sum of Four hundred pounds Upon Trust that thay my said Trustees or the surviver of them or the executers shall and do put and place the same out at intrist upon one or more good and sufficient security or securities and call in and replace the same out again upon like security or securities as to him or them shall seem meet and pay the intrist and annual proceeds thereof by equal half yearly portions unto my dear Wife Mary Wreathall for and during the term of her natural life the first payment whereof shall begin and commence at the expiration of six calendar months from the time of my decease and from and after the decease of her my said Wife Upon further Trust that they my Trustees or the survivor of them or executors shall and do pay the said principal sum of four hundred pounds unto Elizabeth the daughter of my sister Catherine the wife of Stephen Gray of Middleton in the said County of York Labourer who is now married but whose husband name I do not know to and for her own use and benefit I also Give and bequeath unto the said William King and Thomas Bainton the sum of four hundred pounds Upon trust that they my said trustees or the survivor of them or executors shall and do put and place the same out at intrist upon one or more good and sufficient security or securities and call in and replace the same out again upon like security or securities as to him or them shall seem meet and pay and devide the intrist and annual proceeds as the same shall become due and be received in equal shares and proportions between and amongst my three sisters Ann Marshall of Fangfoss? in the said County of York Widow Jane Wreathall of Goodmanham in the same County Spinster and the said Catherine Gray for and during the term of their respective natural lives and from and immedeately after the decease of any one or more of them my said three sisters Upon this further trust that they my said Trustees or the survivor of them or executors shall and do pay the proportions or proportion of the said principal sum of four hundred pounds from which such respective shares of intrist so paid to such one or more of my said sisters respectively dying shall ?????? unto my said Niece Elizabeth the Douter of my said sister Catharine Gray and from and after the decease of them my said three Sisters Ann Marshall Jane Wreathall and Catharine Gray I Give and Bequeath the whole of the said principal sum of four hundred pounds unto my said niece Elizabeth the dauther of my said Sister Catharine Gray to and for her own use and benefit I Give and Bequeath unto the said William King and Thomas Bainton the sum of One hundred pounds upon Trust that thay my said Trustees or the survivor of them or the executers shall and do put and place the same out at intrist upon one or more good and sufficient security or securities and call in and replace the same out again upon like security or securitys as to them shall seem meet and pay the intrist and annual proceeds thereof from time to time as the same shall become due and be received in equal maches? for and towards the education maintenance and support of William Wreathall and Arabella Wreathall the children of William Wreathall heretofor of Skipton in the said County of York weaver deceased until they shall respectively attain the age of twenty one years and when and as they shall severally attain that age I Give and Bequeath one equal moiety or half of the said principal sum of One hundred pounds unto each of them the said William and Arabella Wreathall so respectively attaining that age and in case either of them the said William Wreathall or Arabella Wreathall shall happen to depart this life under the age of twenty one years then and in such case I order and direct that the intrist and annual proceeds of the moiety or half share of the said principal money of him or her so respectively dying shall be payed and applied by them my said Trustees the survivor of them or Executers for and towards the education maintenance and support of the survivor of them until they shall attain that age I Give and Bequeath such moiety or half part of the said principal sum of One hundred pounds unto and equally to be devided betwin them but in case both of them the said William Wreathall and Arabella Wreathall shall happen to depart this life under the age of twenty one years without issue then I order and direct that the said principal sum of One hundred pounds shall laps and sink into the residue of my personal estate and Trust the same shall be paid and applied in manner hereinafter mentioned with respect to the residue of my personal estate I Give and Bequeath unto my said dear Wife Mary Wreathall all my housold goods and furniture plate linen china and implements of housold save except to and for her own use I Give and Bequeath unto my said Niece Elizabeth the dauther of the said Catharine Gray the fether bed whereon I usually sleep with the bedding thereto belonging and also the oak chest which now stands in my lodging room I Give and Bequeath unto James Smith of Wansford Carpet Weaver the sum of fifty pounds to be paid to him at the expiration of twelve calendar months from the time of my decease I Give and Bequeath unto James Simpson Robert Simpson Ann Simpson and Hannah Simpson the sons and dauther of Thomas Simpson late of Hutton in the Hole in the said County of York Wheelwright deceased the sum of twenty pounds apiece to be paid to them respectively at the expiration of twelve calendar months from the time of my decease I Give and Bequeath unto John Allison? of Kirby Moorsides in the said County of York Stone Mason and to Ann the daughter of Thomas Allison? of the same place Stone Mason the sum of ten pounds apiece to be paid to them respectively at the expiration of twelve calendar months from the time of my decease I Give and Bequeath unto Herenhappuck? the wife of William Kirby of Sancton Blacksmith the sum of fifty eight pounds to be paid to her at the expiration of twelve calendar months from the time of my decease I Give and Bequeath all my money morgages bonds bills and securities for money goods and chattels not hereinbefore otherwise disposed of and also all the residue and remainder of my personal Estate and Effects whatsoever and wheresoever charged with the payment of my just debts funarl expences the expence of proving and registering this my Will and the payment of the several legacies hereinbefore by me bequeathed unto the said William King and Thomas Bainton and I hereby oder and direct that thay the said William King and Thomas Bainton or the survivor of them or the executers shall stand seezed and possessed of the clear surplus of such residue for the benefit of my said Niece Elizabeth the daughter of my sister Catharine Gray and I hereby Give and Bequeath such surplus unto my said Niece acordingley and request that the same may be paid and transfard to hir my said Niece by my said Trustees or the survivor of them or executers as soon as may be after my decease and I further oder and direct that my said Trustees shall not be answerable or accountable the one for the other of them or for the acts receats neglects or defalts of each other but each of them for his own acts receats neglects and defalts only nor shall thay or either of them be answerable or accountable for any more or other of the said trust money then shall come to their respective hands nor for any loss which may happen thereto by failure of securities or otherwise unless the same shall so happen by or through his or their wilfull neglect or default And further that my said Trustees shall and may by and out of the said trust monies which shall come to their hands retain to and reimburse themselves and each other all such costs charges demands and expenses as thay or either of them shall or may necessarly sustain expend or be put unto in about touching or concerning the execution of the trusts hereby in them reposed Lastly I make constute and appoint the said William King and Thomas Bainton joint Executors in trust of this my last Will and Testament and do hereby revoke all former Wills by me maid In Witness whereof I the said Robart Wreathall the Testator have hereunto set my hand and seal the day and year first herein written Robt Wreathall (image of seal) Sined sealed and declared in the presence of us who both sined our names as Witnesses theirto   John Brown   Thomas Havison   Richard Hodenby
